本协议是你与北京天怡宝宝数字科技有限公司（以下称"我们"）之间，关于"Capyroom 水豚温泉"App（以下称"本应用"）的协议。你安装或使用本应用，即表示同意本协议。关于我们如何处理数据，见隐私政策，它是本协议的一部分。
本应用是一个专注计时器：你开始专注，水豚就在池子里陪你泡着；休息时它上岸。它是本地优先的：你的专注记录、编排、定时计划和偏好都保存在你自己的设备上，核心功能——计时、编排、翻看记录——不需要账号、不需要联网。
计时能力永远不设付费门槛。我们不限制你每天能专注多久、能留多少记录。付费内容只增加场景主题，绝不拿走计时的能力。
账号是可选的，只用来在你自己的多台设备之间同步数据、以及承载你买过的内容。中国区可以用手机号或 Apple 登录，其他地区可以用 Apple 或 Google 登录。
请自行保管你所使用的登录方式。如果你失去了那个手机号 / Apple / Google 账号，我们没有别的办法确认你是这些数据和购买内容的主人。
你可以随时在调汤 → 账号里删除账号。删除账号会同时删除服务器上与该账号相关的全部数据，包括购买记录——删号后再次登录拿到的是一个全新账号，之前通过支付宝购买的内容不会回到这个新账号上（通过 App Store / Google Play 购买的仍可用"恢复购买"取回）。
如果一个账号被用于攻击服务、在不付费的情况下获取付费内容，或有第七条所列的其他违规用途，我们可能暂停该账号。
付款通道取决于你使用的版本：通过 App Store 或 Google Play 购买时，由 Apple 或 Google 处理；中国版的安卓官网直装包通过支付宝付款。无论哪条通道，我们都不接触你的银行卡号与支付密码。
我们出售的全部内容都是一次性买断、永久有效，没有订阅、没有自动续费，也不设任何抽取、开箱等随机机制。
付费内容属于数字化商品。付款成功、权益记入你的账号或本设备的那一刻，即视为交付完成，没有发货环节，也没有等待期。
价格可能调整。调整不影响你已经买到的东西：不会事后向你补收，降价时也不退差价。不同地区、不同通道的标价可能不同，以你付款时看到的为准。
你买到的内容仅供你本人使用，不得转让、出租、出售或与他人共享。换设备或重装后：通过 App Store / Google Play 购买的，在调汤 → 恢复购买取回；通过支付宝购买的，登录同一个手机号即可取回。
通过 App Store 或 Google Play 购买的，退款由 Apple 或 Google 依其各自政策受理与处理，我们无权代为决定，请通过它们的官方渠道申请。
通过支付宝直接向我们购买的：付费内容属于数字化商品，付款成功即完成交付。根据《中华人民共和国消费者权益保护法》第二十五条，在线下载或者消费者拆封的数字化商品不适用七日无理由退货，因此已完成交付的付费内容不提供无理由退款。
下列情形不受上述限制，请联系 service@tybbtech.com（请附订单号，我们在 7 个工作日内答复）：① 重复扣款；② 付款成功但权益未到账，且用"恢复购买"也取不回来；③ 因我们的原因导致你已购买的内容长期无法使用；④ 法律法规规定我们应当退款的其他情形。
本条不排除、不限制法律法规赋予你的、我们不得排除的消费者权利。
不满十八周岁的用户，请在监护人陪同下阅读本协议，并在取得监护人同意后再进行付费。如果发生未成年人未经监护人同意的付费，请联系我们（通过 Apple / Google 购买的还需联系相应平台），我们会在核实后配合处理。
如果我们决定停止本应用的运营，将至少提前 30 日在 App 内和官网公告。自公告之日起，我们停止销售全部付费内容。
因为本应用是本地优先的：你的记录留在你自己的设备上，你已购买的主题在停止运营后仍可在已安装该 App 的设备上继续使用（场景素材已缓存在设备上；受你的设备与操作系统环境限制）。依赖服务器的功能——账号同步、恢复购买、下载新素材——将停止。
如果停止运营公告发出时，你购买主题包不满 30 日，可在公告后 30 日内联系我们，我们予以退款。
你的专注记录归你所有，我们不主张任何所有权。登录后同步到服务器的数据只用于在你的设备之间同步，详见隐私政策。
场景画面、动画、庭院物件、界面、文案以及 App 本身，其著作权及其他权利归我们（或我们的许可方）所有，受法律保护。购买主题包，取得的是在本应用内使用它的个人权利，不发生任何权利转让，也不允许你提取、再分发或转售这些素材。
本应用按其现状提供。我们会尽力维持服务可用，但不保证运行绝不中断、绝无差错。
你的记录在你自己的设备上。如果你在未登录同步的情况下卸载了 App、丢失了设备或清除了数据，记录就没有了，我们无法为你恢复。
在法律允许的范围内，我们就本应用对你承担的赔偿责任总额，以你在主张发生前 12 个月内就本服务向我们实际支付的金额为限。本条不排除依法不能排除的责任。
我们可能更新本协议。最新版本始终在本页，页首标明生效日期。如果某次修改实质性减少了你的权利，我们会至少提前 7 日在 App 内公告。公告后你继续使用本应用，视为接受新版本；如不接受，你可以停止使用并删除账号。
本协议适用中华人民共和国法律（就本条而言不包括香港、澳门、台湾地区）。因本协议产生的争议，双方应先友好协商解决；协商不成的，任何一方可向我们住所地有管辖权的人民法院提起诉讼。

These Terms are the agreement between you and Beijing Tianyi Baobao Digital Technology Co., Ltd. (“we”, “us”) for the Capyroom app (“the app”). By installing or using the app you agree to them. How we handle data is covered separately in our Privacy Policy, which forms part of these Terms.
Capyroom is a focus timer: when you start focusing, a capybara soaks in the pool with you; on breaks it climbs out. It is local-first: your sessions, sequences, schedules and preferences live on your device, and the core of the app — timing, sequencing, looking back — works with no account and no network.
Timing is never behind a paywall. Paid content adds scene themes; it never takes away the ability to focus.
An account is optional and exists only to sync your data between your own devices and to hold your purchases. In China you can sign in with a phone number or Apple; elsewhere with Apple or Google.
You are responsible for keeping access to the sign-in method you used. If you lose access to that phone number, Apple or Google account, we have no other way to identify you as the owner of the data or the purchases.
You may delete your account at any time under Tune → Account. Deleting the account also deletes all data associated with it on our servers, including purchase records made through Alipay; signing in again creates a brand-new account. Purchases made through the App Store or Google Play can still be recovered with Restore Purchases.
We may suspend an account that is being used to attack the service, to obtain paid content without paying for it, or otherwise in breach of section 7.
The payment channel depends on your edition: purchases through the App Store or Google Play are processed by Apple or Google; the Android edition distributed from our website in China uses Alipay. In every case we never see your card number or payment password.
Everything we sell is a one-time purchase, permanent, with no subscription, no auto-renewal, and no loot boxes or randomised items.
Paid content is digital. Delivery is complete the moment your payment succeeds and the entitlement is recorded to your account or device; there is no shipping and no waiting period.
Prices may change. Changes never affect what you have already bought: we do not charge you more afterwards, nor refund the difference after a price drop. Prices may differ by region and channel; the price shown at checkout applies.
Purchased content is for your personal use only and may not be transferred, rented, sold or shared. After changing devices or reinstalling: App Store / Google Play purchases are recovered under Tune → Restore Purchases; Alipay purchases return when you sign in with the same phone number.
For purchases made through the App Store or Google Play, refunds are handled by Apple or Google under their own policies. We cannot decide them on their behalf; please apply through their official channels.
For purchases made directly from us through Alipay: paid content is digital goods, delivered on successful payment. Under Article 25 of the Consumer Rights Protection Law of the PRC, digital goods that are downloaded online are not subject to the seven-day no-reason return, so delivered paid content is not refundable without cause.
The following cases are exceptions — contact service@tybbtech.com with your order number and we will reply within 7 working days: ① duplicate charges; ② payment succeeded but the entitlement never arrived and Restore Purchases does not recover it; ③ purchased content unusable for an extended period due to our fault; ④ any other case where the law requires a refund.
Nothing in this section excludes or limits consumer rights that the law grants you and that we may not exclude.
If you are under 18, please read these Terms with a guardian and obtain their consent before purchasing. If a minor has made a purchase without consent, contact us (and Apple or Google for their channels) and we will cooperate after verification.
If we decide to discontinue Capyroom, we will announce it in the app and on our website at least 30 days in advance and stop selling paid content from that day. Because the app is local-first, your records stay on your device and purchased themes keep working on devices where the app is installed (scene assets are cached locally; subject to your device and OS). Server-dependent features — sync, Restore Purchases, downloading new assets — will stop. If you bought a theme pack less than 30 days before the announcement, contact us within 30 days of it for a refund.
Your records belong to you; we claim no ownership. Data synced after sign-in is used only to sync between your devices — see the Privacy Policy.
Scene artwork, animations, garden items, the interface, the copy and the app itself are protected by copyright and other rights held by us or our licensors. Buying a theme pack grants you a personal right to use it inside Capyroom; no rights are transferred, and you may not extract, redistribute or resell these assets.
The app is provided as is. We do our best to keep the service available but do not guarantee uninterrupted or error-free operation. Your records are on your device; if you uninstall the app, lose the device or clear its data without having synced, the records are gone and we cannot recover them. To the extent permitted by law, our total liability to you in connection with the app is limited to the amount you actually paid us for the service in the 12 months before the claim. This does not exclude liability that cannot be excluded by law.
We may update these Terms. The current version is always on this page with its effective date. If a change materially reduces your rights, we will announce it in the app at least 7 days in advance. Continuing to use the app after the notice means you accept the new version; if you do not, you may stop using the app and delete your account.
These Terms are governed by the laws of the People’s Republic of China (excluding, for this purpose, Hong Kong, Macau and Taiwan). Disputes should first be resolved through friendly negotiation; failing that, either party may bring an action before the competent people’s court where we are domiciled.
